Acceptable Use Policy

This Acceptable Use Policy (“AUP”) supplements the ThrottleShare Terms of Service and applies to every user of the Platform. Violations may result in listing removal, account suspension, permanent ban, referral to law enforcement, and/or civil liability.
1. Prohibited Listings
You must not list:
- Any vehicle you do not have clear legal authority to rent (no stolen, leased-without-permission, repossessed, or lien-encumbered units)
- Any vehicle that is not registered, titled, or inspected as required by its jurisdiction
- Any vehicle with a known, unrepaired safety defect or recall
- Firearms, ammunition, or firearm accessories
- Aircraft, drones, or any FAA-regulated device
- Commercial-use-only equipment without valid commercial insurance
- Any vehicle priced to circumvent Platform fees (e.g., $1 listings with off-platform payment expectation)
2. Prohibited Content
You must not upload, post, or transmit:
- Nude, sexually explicit, pornographic, or sexually suggestive content in any photo, video, or description
- Images of minors in swimwear, undergarments, or any sexually suggestive context
- Copyrighted photos, video, music, or text you do not have a license to use (see our DMCA Policy)
- Hate speech, threats, harassment, stalking, or incitement against any protected group
- Content that promotes terrorism, extremism, violent crime, or self-harm
- Malware, viruses, spyware, phishing links, or any code intended to compromise the Platform or other users
- Personal data of other people (addresses, phone numbers, ID documents) without their written consent
- False, defamatory, or misleading statements about any person or business
- Advertising for competing rental platforms or services
3. Prohibited Conduct
You must not use the Platform to:
- Violate any federal, state, local, or international law
- Operate any vehicle while under the influence of alcohol, drugs, or any impairing substance
- Allow anyone under 18 to use the Platform or operate any rented vehicle
- Circumvent or attempt to circumvent our fee structure, account registration checks, age gate, or rate limiting
- Contact another user with the purpose of moving the transaction off-platform
- Harass, threaten, intimidate, or discriminate against other users
- Scrape, harvest, data-mine, or reverse engineer the Platform
- Use automated tools (bots, scripts, crawlers) to create accounts, post listings, or send messages
- Create multiple accounts to evade a ban, boost rankings, write fake reviews, or inflate activity
- Impersonate any person, business, or entity, or misrepresent your affiliation
- Solicit or collect payment outside of the Platform's payment system
- Engage in fraud, money laundering, identity theft, or deceptive commercial practices
- Probe, scan, or test the vulnerability of the Platform without our prior written consent (see Security Policy)
4. Safety Requirements
Owners must:
- Provide working, Coast-Guard-approved life jackets (one per seat) for watercraft rentals
- Provide DOT-approved helmets (as applicable) for dirt bikes, ATVs, UTVs, and motorcycles, or require Renters to bring their own
- Document the vehicle's condition with photos or video at handoff and return
- Disclose all known defects, operating limitations, and legal restrictions in writing in the listing
- Not rent to anyone who appears intoxicated, underage, or unlicensed for the vehicle class
Renters must:
- Hold all licenses, permits, endorsements, and certifications required by law for the vehicle class
- Complete the digital liability waiver before each rental
- Use all required safety equipment
- Immediately report any accident, injury, or vehicle damage to the Owner and to ThrottleShare
5. Reporting Violations
Report any suspected violation of this AUP to [email protected] with the subject line “AUP Violation”. Include URLs, screenshots, and any other evidence.
6. Enforcement
ThrottleShare may, at its sole discretion and without prior notice:
- Remove any listing, message, photo, review, or other content
- Suspend or permanently ban any account
- Hold, reverse, or refuse any payout
- Retain transaction records, IP logs, and waiver evidence in accordance with our Privacy Policy
- Cooperate with law enforcement, subpoenas, and court orders
- Pursue civil damages for any violation that causes loss to the Platform or its users
Violations of this AUP may also be violations of the Terms of Service, and the limitation of liability and indemnification sections of the Terms apply to all AUP-related claims.
