ThrottleShare (a d/b/a of Deer Track Design LLC) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, ThrottleShare will respond expeditiously to valid notices of claimed copyright infringement.

How to Submit a DMCA Takedown Notice
To be effective under the DMCA, your written notice must include substantially all of the following (see 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including information reasonably sufficient to let us locate it (URLs on ThrottleShare).
- Your contact information — full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. Do not make false claims.
Counter-Notice
If content you posted has been removed in response to a DMCA takedown and you believe the removal was in error, you may submit a counter-notice to our DMCA agent containing substantially all of the following (see 17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it previously appeared.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the federal court for the judicial district in which your address is located (or the United States District Court for the Northern District of Illinois if you are outside the U.S.), and that you will accept service of process from the person who submitted the original takedown notice.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), ThrottleShare will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. ThrottleShare may also, in its sole discretion, limit access to the Service or terminate the accounts of users who infringe any intellectual property rights, whether or not there is any repeat infringement.
