ThrottleShare Is a Marketplace Platform — Not a Rental Company
ThrottleShare is a technology platform operated by Deer Track Design LLC that connects individual vehicle owners with people seeking to rent powersports vehicles. ThrottleShare is not a licensed insurance company, vehicle broker, financial advisor, or rental company. ThrottleShare is not a party to any rental agreement between users. All transactions are solely between the Owner and the Renter.
1. Platform-Only Role
ThrottleShare facilitates peer-to-peer rentals by providing a marketplace where vehicle owners can list their powersports vehicles and renters can browse, book, and pay. ThrottleShare does not own, manage, control, inspect, or operate any of the vehicles listed on its platform. We are not an agent, broker, or representative of any Owner or Renter.
Any rental agreement formed through the platform is a direct contract between the Owner and the Renter. ThrottleShare is not a party to that agreement and accepts no liability for its performance, breach, or the conduct of either party.
2. Insurance Notice
ThrottleShare does not provide insurance coverage to Owners or Renters. Any "ThrottleShare Protection Plan" or similar offering referenced on the platform is a platform-facilitated arrangement and not an insurance product regulated under state insurance law. It does not replace personal insurance coverage.
- Owners are solely responsible for maintaining adequate insurance on their vehicles, including liability coverage for rental use. Standard personal powersports insurance policies often exclude commercial rental activity — Owners must confirm rental coverage with their insurer before listing.
- Renters should verify whether their personal insurance policy, umbrella policy, or credit card benefits extend coverage to rented powersports vehicles. Most credit card rental coverage programs exclude powersports, ATVs, UTVs, watercraft, and off-road vehicles.
- Neither party should assume they are covered without explicit confirmation from their insurance provider in writing.
ThrottleShare strongly recommends that all users consult a licensed insurance professional before engaging in any rental transaction on the platform.
3. Vehicle Operation Disclaimer
Renters are solely responsible for the safe and lawful operation of any vehicle rented through the platform. ThrottleShare makes no representations regarding the mechanical condition, road-worthiness, or trail-worthiness of any listed vehicle.
- ATVs, UTVs, and off-highway vehicles (OHVs) are not street-legal in most US states and may only be operated on designated trails, private land, or approved off-road areas.
- Watercraft operation requires compliance with applicable US Coast Guard regulations and state boating laws, including any required boating safety certification.
- Snowmobile operation is restricted to designated groomed trails, private property, or areas expressly open to snowmobile use. Trespassing on private land is illegal.
- Renters should check local regulations before operating any rented vehicle on public roads, trails, or waterways.
- Operating a powersports vehicle under the influence of alcohol or controlled substances is illegal and grounds for immediate termination of the rental.
4. State-Specific Regulatory Notices
Powersports regulations vary significantly by state. The following is a general summary — it is not legal advice. Users must verify current regulations in their jurisdiction before operating any rented vehicle.
ATV / UTV Street Legality: Most states prohibit ATV and UTV operation on public roads except for controlled crossings. States with limited street-legal provisions include Arizona, Texas, Utah, and Montana — each with specific equipment and registration requirements.
Trail Access: National forest, BLM, and state-managed trail systems often require an OHV permit or trail pass. Check with the relevant land management agency before riding on public lands.
Watercraft: Many states require a boating education certificate for personal watercraft (PWC) operators, particularly for renters under age 26. Florida, California, Texas, Michigan, and other states have specific PWC age restrictions.
Snowmobiles: Snowmobile registration requirements, trail permit requirements, and age restrictions vary by state. Michigan, Minnesota, and Wisconsin have strict groomed-trail systems with associated fee requirements.
Helmets: Helmet laws for ATVs, motorcycles, and dirt bikes vary by state. Several states mandate helmets for riders of all ages; others only for minors.
ThrottleShare assumes no responsibility for regulatory violations by Owners or Renters. It is the user's responsibility to understand and comply with all applicable laws.
5. Tax Responsibility
Rental income earned by Owners through the ThrottleShare platform is taxable income. Owners are solely responsible for accurately reporting all rental income to the Internal Revenue Service (IRS) and applicable state tax authorities. ThrottleShare may issue a Form 1099-K to Owners who meet applicable reporting thresholds under federal law.
Owners may be eligible to deduct certain expenses related to their rental activity, including depreciation, maintenance, insurance, and platform fees, subject to IRS rules on passive activity and mixed-use (personal/rental) property. ThrottleShare does not provide tax advice. Consult a qualified tax advisor or CPA before filing.
Renters who use a rented powersports vehicle for legitimate business purposes may have deductible rental expenses. Consult a tax professional for guidance specific to your situation.
In certain jurisdictions, short-term rental activity may be subject to state and local sales tax, lodging tax, or excise tax. Owners are responsible for determining and remitting any applicable taxes.
6. Arbitration and Dispute Resolution Notice
As set forth in our Terms of Service, disputes between ThrottleShare and users are subject to binding individual arbitration, to the fullest extent permitted by law. By using the platform, you waive your right to participate in class action lawsuits or class-wide arbitration against ThrottleShare.
Disputes between Owners and Renters arising from a rental transaction are not subject to ThrottleShare's arbitration clause — those are governed by the terms agreed between the parties in their rental agreement.
7. Governing Law and Jurisdiction
ThrottleShare is operated by Deer Track Design LLC, a limited liability company organized and operating in the United States. All disputes arising from or related to the use of the ThrottleShare platform that are not resolved through arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, and both parties consent to personal jurisdiction in such courts.
These disclosures and the ThrottleShare Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
8. No Financial or Investment Advice
Any earnings estimates, rental rate benchmarks, or income projections provided on the ThrottleShare platform (including in blog posts, calculators, and marketing materials) are illustrative examples based on market observations and user data. They are not guarantees of income. Actual results will vary based on location, vehicle type, condition, pricing, seasonal demand, and owner effort.
